With the Open App Markets Act (OAMA) making its way through the Senate, at least 86% of developers are in favor of app marketplace legislation.

The OAMA is bipartisan legislation aimed at Apple’s App Store and Google’s Play Store. The legislation is designed to reduce Apple and Google’s role as gatekeepers for their respective platforms.

“This legislation will tear down coercive anticompetitive walls in the app economy, giving consumers more choices and smaller startup tech companies a fighting chance,” said Senator Richard Blumenthal. “For years, Apple and Google have squashed competitors and kept consumers in the dark—pocketing hefty windfalls while acting as supposedly benevolent gatekeepers of this multi-billion dollar market. I’m proud to partner with Senators Blackburn and Klobuchar in this breakthrough blow against Big Tech bullying. This bipartisan bill will help break these tech giants’ ironclad grip, open the app economy to new competitors, and give mobile users more control over their own devices.” 

According to the Coalition of App Fairness, 86% of developers want legislation that will prevent anti-competitive practices, as well as prevent Apple and Google from favoring their own apps and services. Developers clearly hope the OAMA will help level the playing field.

“The evidence is clear – app developers want the Open App Markets Act to pass so that they can have the opportunity to compete in a fair digital marketplace,” said Meghan DiMuzio, Executive Director for the Coalition for App Fairness. “For too long, developers have been harmed by gatekeepers’ monopolistic practices, and consumers have suffered from less choice and innovation. We applaud Congress’ leadership on this issue to date and continue to urge members of Congress to act quickly to ensure a fair and competitive marketplace.”

Less than two weeks after Microsoft announced it was purchasing Activision Blizzard, Sony has announced a deal to purchase Bungie.

Bungie rose to fame as the original makers of Halo. Microsoft quickly swooped in, purchasing the company in 2001. Just a few years later, in 2007, Bungie was spun off as a privately held company. Since becoming independent again, Bungie has continued releasing games, most notably the Destiny franchise.

Bungie will once again be purchased by a larger company, this time Sony Interactive Entertainment (SIE). The two companies announced the deal, worth some $3.6 billion, on Monday, January 31.

“In SIE, we have found a partner who unconditionally supports us in all we are and who wants to accelerate our vision to create generation-spanning entertainment, all while preserving the creative independence that beats in Bungie’s heart,” reads Bungie’s blog post. “Like us, SIE believes that game worlds are only the beginning of what our IPs can become. Together, we share a dream of creating and fostering iconic franchises that unite friends around the world, families across generations, and fans across multiple platforms and entertainment mediums.​“

Bungie says it will continue to have the same creative freedom it has enjoyed for years.

“We remain in charge of our destiny,” the blog continues. “We will continue to independently publish and creatively develop our games. We will continue to drive one, unified Bungie community. Our games will continue to be where our community is, wherever they choose to play.​“

As the video game market heats up, larger companies are snapping up smaller ones that fit in with their plans. The metaverse — the intersection of physical, augmented, and virtual reality — is speeding up this consolidation, with companies seeing game makers as a way to game a foothold.

It should be interesting to see what Bungie will be able to develop with Sony’s deep pockets backing the company.

Blackberry is selling off its legacy patents, primarily covering mobile devices, messaging, and wireless connectivity, to the tune of $600 million.

Blackberry was once one of the most popular smartphone manufacturers, selling devices with their distinctive physical keyboard. The devices were popular with professionals and consumers alike, since the keyboard made it extremely easy to text, email, browse the web, and more. Like many brands, however, the iPhone spelled doom for Blackberry’s handset business and the company has since pivoted to software.

The company is now selling its legacy patents, patents that seem to largely cover its old handset business. The patents are being sold to Catapult IP Innovations Inc., a special purpose vehicle formed specifically to purchase Blackberry’s IP.

Blackberry will receive $450 million in cash, supplied by funding Catapult IP secured, as well as a promissory note of $150 million for the balance. Blackberry will also retain a license to the patents it is selling.

It remains to be seen what Catapult IP plans to do with the patents.

While larger ISPs have the IP and human resources needed to response swiftly to threats, smaller ISPs often can’t compete.

Davidavicius used the example of a recent DDoS attack against Vocus NZ, New Zealand’s third-largest ISP.

“The pressures of having to make swift decisions can have a significant impact when managing security breaches. In this case, it seems that a few unfortunate decisions led to filtering out tons of legitimate traffic for all, leaving users without an Internet connection,” Davidavicius explained.

“Cyber resilience has always been one of the top priorities, however, there is no single best solution that could address all the issues. As with all internet-related activities, the best way to protect yourself varies based on use cases and scope,” he continued.

Unfortunately, until smaller ISPs are able to address their limitations, they will continue to be a weak link that hackers can exploit, leading to further internet outages.

China Unicom Americas’ is the latest Chinese company to be banned in the US, with the Federal Communications Commission (FCC) announcing it January 27.

Chinese companies are increasingly coming under pressure from the US, over a combination of national security concerns and souring trade relations with China. In particular, the US has voiced concerns about the role Chinese companies play in supporting Beijing’s espionage efforts. Huawei is the most high-profile company banned by the US and its allies, resulting in Huawei’s business being crippled.

China Unicom Americas’ has now suffered the same fate as Huawei, with the FCC banning it from doing business in the US.

The Order on Revocation directs China Unicom Americas to discontinue any domestic or international services that it provides pursuant to its section 214 authority within sixty days following the release of the Order. Based on input from Executive Branch agencies, thorough review of the company’s responses in this proceeding, the public record, and the FCC’s public interest analysis under the law, the Commission finds that today’s action safeguards the nation’s telecommunications infrastructure from potential security threats.

Meanwhile, China Telecom told AFP News that the FCC”s decision was “without any justifiable grounds and without affording required due process.”

In the latest example of unadulterated greed, LG is planning to serve its users even more ads on TVs they have spent hundred of dollars on.

As we have pointed out many times in the past, it’s one thing for companies like Google or Facebook to make money selling ads to people. They are, after all, providing their services free-of-charge. When a customer spends hundreds of dollars on a piece of hardware, however, there’s a certain expectation that they will get to enjoy that product ad-free.

Those days may be over, if LG Ad Solutions has anything to say about. Not content to charge a premium for its TVs, the company is evidently planning on bombarding its users with even more ads. Unlike traditional TV commercials, these ads are in LG’s smart TV interface, meaning there’s no way to easily avoid them when using the built-in features.

“We’re turning the tables for advertisers, making performance not just something brands aim for, but something that is actually guaranteed,” said chief executive officer Raghu Kodige. “Whether driving sales, conversions, or customer acquisition, advertisers struggle to quantify ROAS for TV spend. We created this extensive program as the starting point in a new paradigm for TV-driven outcomes in which marketers are assured every CTV ad dollar hits the bullseye.”

Worse yet, the company plans on greatly expanding the metrics it uses to track the effectiveness of ad campaigns.

The conversion metrics program will begin immediately with app installs and is available globally. More conversion metrics such as tune-in, web visits, physical location visits, and more, will be available in the coming months both in the U.S. and globally. 

There’s just one thing LG seems to have forgotten: Advertisers aren’t the ones buying their TVs, meaning advertisers should not be the company’s prime concern — its customers should be. 

Fortunately, users still have a way to opt out, albeit at an added expense. Users who don’t want to see LG’s ads should not give the TV internet access and use a third-party device, such as an Apple TV, instead.

Google is backing down after igniting a firestorm, and will not force free, legacy G Suite accounts to upgrade to paid Google Workspace plans.

Google allows individuals and businesses to use its services in concert with their own domain name. This means they can have an email that ends in their domain name, rather than @gmail.com. For years, it was possible to sign up for this service, called G Suite, for free.

Eventually Google renamed the service to Google Workspace and ended the free accounts, although existing accounts were grandfathered in. Unfortunately, last week the company said it was killing off all free accounts, and users would have to migrate to a paid Workspace account or lose their account altogether.

Needless to say, Google’s plans went over like a lead balloon and the company is finally backing down. In a new support page section, the company is now giving individuals the option to move to another free account.

In the coming months, we’ll provide an option for you to move your non-Google Workspace paid content and most of your data to a no-cost option. This new option won’t include premium features like custom email or multi-account management. You’ll be able to evaluate this option prior to July 1, 2022 and prior to account suspension. We’ll update this article with details in the coming months.

The change of plans is no doubt welcome news to remaining G Suite users.

The biometric feature will focus on a person’s facial characteristics around their eyes to unlock the phone, although Apple warns it won’t be as secure as full facial recognition.

Users who choose to enable the new feature will be greeted with the following prompt:

Face ID is most accurate when it’s set up for full-face recognition only. To use Face ID while wearing a mask, iPhone can recognize the unique features around the eye area to authenticate.

It’s a safe bet most users will still opt to activate the feature.

These practices are one of the reasons internet companies often rank among the most-hated in the US.

The FCC is now taking a significant step toward addressing the problem, requiring broadband companies to provide customers with easy-to-read labels that will facilitate comparison shopping. The inspiration behind the labels is the nutrition labels that are required on food sold in grocery stores.

“If you walk into any grocery store and pull boxes of cereal from the shelves, you can easily compare calories and carbohydrates,” said FCC Chairwoman Jessica Rosenworcel. “That’s because they have a common nutrition label. It’s black and white, simple to read, and easy to understand. It helps consumers make good choices.

“I think the Federal Communications Commission needs to do the same with broadband. That’s because it is now an essential service—for everyone, everywhere. So we want to make it easier for consumers to compare their options and understand just what they’re signing up for. We want to develop a consistent and straightforward way of providing accurate information about price, speed, data allowances, and other aspects of high-speed service. We want to end efforts to bury facts in the fine print and we want to stop unexpected costs and fees.”

Not only did the move have unanimous support from the FCC’s commissioners, but it’s sure to be a big hit with consumers.

GM CEO Mary Barra is throwing down the gauntlet, claiming her company will top Tesla in the EV market.

Tesla is the current reigning champion of the EV market. The company was synonymous with EVs for years, with traditional automakers only recently beginning to pivot to EVs en masse.

GM is one such company, and is investing heavily in the transition, recently announcing a $7 billion investment in several Michigan plants, in an effort to convert half of its North America productions to EVs by 2030.

Barra, however, has her sights set on a much more ambitious goal: unseating Tesla as the top dog in the EV market.

“We want to lead in EVs. Full stop,” Barra told CBS News’ Ben Tracy. “And so that’s where we’re aggressively moving.”

A big part of that plan is making more affordable EVs, much cheaper than the company’s Hummer, or Tesla’s upcoming Cybertruck.

“The Equinox EV crossover is going to start around $30,000,” she said. “We’re also working on a vehicle that will even be more affordable than that.”

“Customers are starting to be much more interested in EVs but they want the vehicle they want,” she added.

As CBS News points out, GM definitely has an uphill battle. Tesla has 70% of the US EV market, compared to GM’s 6%. Nonetheless, Barra appears undeterred.

“When you look at how many vehicles we’re going to be able to launch across many segments, that’s why by mid-decade we think we’ll be in a leadership position,” she said.

“Clearly, that’s what we’re working from a North America perspective and we’re just gonna keep going until we have global leadership as well.”

Intel Wins Massive EU Antitrust Case, Overturning €1 Billion Fine

Intel has scored a major legal victory in the EU, overturning a 12 year-old verdict that resulted in a €1 billion fine.

The case stemmed from Intel’s practice of offering rebates to computer manufacturers if they primarily used its chips, rather than rival AMD’s. The EU Commission fined Intel €1 billion for what it perceived as Intel abusing its dominant market position.

According to The Irish Times, the General Court annulled the decision, criticizing the EU Commission’s decision.

“The (European) Commission’s analysis is incomplete and does not make it possible to establish to the requisite legal standard that the rebates at issue were capable of having, or likely to have, anticompetitive effects,” judges said.

Interestingly, the General Court — the EU’s second-highest — had previously upheld the decision in 2014. The EU’s highest court, the EU Court of Justice, told the General Court to reconsider Intel’s appeal in 2017, leading to this latest decision.

It’s unclear what will happen next, with the Commission saying it will consider the decision and what, if any, steps it will take next.

Microsoft is warning of a new phishing attack that is abusing OAuth request links and “targeting hundreds of orgs.”

OAuth is an open standard designed to allow services, apps, or websites access to an individual or organization’s information on other services, without the need to provide a password and full access.

Unfortunately, it appears bad actors are using OAuth request links in a phishing attempt to gain access to users’ email. The bad actors are then able to set up filters to forward emails to another account, with experts warning this may be an attempt to acquire sensitive information.

Microsoft warned about the issue on Microsoft Security Intelligence Twitter account:

Microsoft is tracking a recent consent phishing campaign, reported by @ffforward, that abuses OAuth request links to trick users into granting consent to an app named ‘Upgrade’. The app governance feature in Microsoft Defender for Cloud Apps flagged the app’s unusual behavior.=

The phishing messages mislead users into granting the app permissions that could allow attackers to create inbox rules, read and write emails and calendar items, and read contacts. Microsoft has deactivated the app in Azure AD and has notified affected customers.

We’re seeing the campaign targeting hundreds of orgs. Microsoft Defender for Cloud Apps, Azure AD, and Defender for Office 365 can help protect against similar attacks by blocking the OAuth consent links or flagging unusual behavior of users or cloud apps.

After months of intense scrutiny and delays, it appears Nvidia is preparing to abandon its attempts to acquire Arm Holding.

SoftBank first signaled in July 2020 that it was looking sell off its share of Arm Holding, or take the company public, with Nvidia announcing in September of that year that it would acquire Arm for $40 billion. Almost immediately, the deal received widespread criticism, with Arm’s co-founder calling it an “absolute disaster.”

Governments around the world expressed antitrust concerns, opening investigation into the acquisition. The UK signaled it may try to block Nvidia’s efforts, the EU regulators launched an investigation, and the FCC filed a lawsuit to block the deal.

According to a report by Bloomberg, it appears Nvidia may be ready to abandon the deal altogether. According to Boomberg’s source, while the company publicly says it is still trying to make it happen, it is privately telling partners that it doesn’t expect the deal to go through.

Many countries and industry experts were concerned that Nvidia would keep Arm’s best innovations to itself, giving it a competitive advantage. Given Arm’s long-standing practice of licensing its semiconductor designs to anyone who wanted to use them, any change in how the company might operate under Nvidia could cause massive ripple effects throughout the industry.

Meanwhile, the UK was especially concerned about its premier semiconductor company being under the control of a US corporation at a time when the semiconductor industry is being impacted by national security concerns like never before.

Ultimately, Nvidia has not been able to effectively address these concerns, leading to the current situation.

T-Mobile, Verizon, and AT&T are racing to switch their networks over to 5G, rolling out new spectrum as fast as they can. T-Mobile gained a huge advantage with its purchase of Sprint, taking over Sprint’s wealth of mid-band spectrum, which is ideal for 5G deployment. Verizon and AT&T, on the other hand, spent some $68 billion at a single FCC auction to bolster their mid-band spectrum, only to run into issues with the airline industry that have impeded their ability to fully use their spectrum.

Between the early lead T-Mobile was able to take, and its spectrum not being subject to the same concerns as Verizon and AT&T, in terms of the airline industry, T-Mobile has cemented itself as the 5G company to beat in the US.

According to OpenSignal’s January 2022 5G Experience Report, T-Mobile now wins in four of six categories: 5G Availability, 5G Reach, Upload Speed, and Download Speed. Verizon won the other two categories, 5G Games Experience and 5G Voice App Experience, while AT&T did not win any categories.

Google is once again in the crosshairs for its privacy (or lack thereof), with the DC Attorney General suing it over “Dark Pattern” practices.

Dark Patterns are deceptive practices some websites and apps use to trick users into buying things or taking actions they otherwise wouldn’t, or didn’t mean to. The website DarkPatterns.org is dedicated to shaming companies that engage in this type of behavior.

Google is now facing accusation from the DC Attorney General Karl A. Racine that it is using such Dark Patterns to get its customers to compromise their privacy.

To gain access to user location data, Google manipulates its users through deceptive design choices that alter user decision-making in ways that harm the user and benefit Google. These practices are known as “dark patterns.” Google has made extensive use of dark patterns—such as repeated nudging, misleading pressure tactics, and evasive and deceptive descriptions of features and settings—to stop users from protecting their privacy and cause them to provide more and more data inadvertently or out of frustration.

AG Racine also accuses the company of making it impossible for customers to truly opt out of location tracking, deceiving customers about how much control they have over their privacy, and misleading customers about how much changing device settings really protects their privacy.

AG Racine is leading a coordinated, bipartisan effort to take Google to task for these actions, with the Indiana, Texas, and Washington AGs also filing lawsuits against Google in their states.

“Google falsely led consumers to believe that changing their account and device settings would allow customers to protect their privacy and control what personal data the company could access,” said AG Racine. “The truth is that contrary to Google’s representations it continues to systematically surveil customers and profit from customer data. Googles bold misrepresentations are a clear violation of consumers’ privacy. I’m proud to lead this bipartisan group of attorneys general that will hold Google accountable for its deception. Through this lawsuit, we will hold Google accountable, and in the process, educate consumers on how their personal data—particularly sensitive data about their physical location—is collected, stored, and monetized. This result of our collective action is that consumers, not Google, will determine how their data is or is not used.”

Google seems to have missed the memo on remote work being here to stay, with the company spending a whopping $1 billion to spruce up its UK offices.

Like many large corporations, Google was quick to send its employees home to work remotely at the outset of the pandemic. Like some other large corporations, Google was just as fast to want to bring employees back to the office. The company repeatedly set return-to-office dates, only to move them back as the pandemic continued to drag on.

In its latest move, Google basically postponed a return to the office indefinitely, telling employees it would simply wait for when it was safe to return, rather than shooting for a specific date.

That policy hasn’t stopped the company from preparing for that eventual date, according to the BBC, spending roughly $1 billion to “reinvigorate” its UK offices. Google’s UK head, Ronan Harris, told the outlet that his company still had faith in the office as the future of the workplace.

“We want to reinvigorate the work environment. We’re making this commitment to rebuild. We’re buying these buildings and we’re keen to see everybody come back in and see a vibrant workspace again,” Mr Harris said. 

Google’s engineers have already pushed back on the company’s plans to return to the office, pointing out they have been just as productive working remotely. It’s a safe bet these latest plans are not likely to win the company any additional favor.

Following reports Intel was looking to build two semiconductor plant in Ohio, the company has confirmed the news, calling it a “mega-site.”

Intel is working to reassert its dominance in the semiconductor industry, with CEO Pat Gelsinger even saying AMD is firmly in the company’s “rearview mirror.” As part of its effort, the company has been expanding its manufacturing presence, building a pair of factories in Arizona for $20 billion, and now planning to do the same in Ohio.

Intel is planning to build two semiconductor factories on roughly 1,000 acres in Licking County, just outside of Columbus. The company says the “mega-site” is large enough to support a total of eight such factories, as well as the various partner and support operations necessary for manufacturing.

Intel will initially be investing $20 billion in the two factories, with an additional $100 million dedicated to educational institutions, in an effort to help develop local talent and research. All told, the initial two factories will create 3,000 Intel jobs, in addition to some 7,000 construction jobs, in what is billed as “the largest single private-sector investment in Ohio history.”

Construction will begin in late 2022, with the factories beginning production in 2025.

“Today’s investment marks another significant way Intel is leading the effort to restore U.S. semiconductor manufacturing leadership,” said Pat Gelsinger, CEO of Intel. “Intel’s actions will help build a more resilient supply chain and ensure reliable access to advanced semiconductors for years to come. Intel is bringing leading capability and capacity back to the United States to strengthen the global semiconductor industry. These factories will create a new epicenter for advanced chipmaking in the U.S. that will bolster Intel’s domestic lab-to-fab pipeline and strengthen Ohio’s leadership in research and high tech.”

There are various factors to consider when forming an LLC, including whether or not to form one, the costs, the filing requirements, and so on.

Taxes

Any profit generated by the LLC is immediately distributed to the owners. The owners then record their profits on their own tax returns. Paperwork

The process of forming an LLC is simple, and there is minor paperwork required when compared with other businesses. LLCs are also not required to have official officer responsibilities, keep a record of company minutes, make resolutions, or hold annual meetings, however, if you intend to form an LLC with multiple members, you will need to draft an operating agreement to safeguard your members from any legal conflicts.

The Federal Aviation Administration (FAA) has cleared roughly 78% of the US commercial aircraft fleet for low-visibility approaches near C-band 5G.

The airline industry has been at odds with Verizon and AT&T over the rollout of C-band 5G. C-band is in the mid-band range of frequencies that are very close to those used by aircraft altimeters. The airline industry and FAA have been concerned that C-band could interfere with altimeters, putting aircraft at risk in low-visibility conditions.

After delays and negotiations, Verizon and AT&T began rolling out their new spectrum on January 19, and the FAA has now cleared a large portion of the US aircraft fleet for low-visibility approaches.

“The FAA issued new approvals Thursday that allow an estimated 78 percent of the U.S. commercial fleet to perform low-visibility landings at airports where wireless companies deployed 5G C-band,” the FAA’s statement reads. “This now includes some regional jets. 

“Airplane models with one of the 13 cleared altimeters include all Boeing 717, 737, 747, 757, 767, 777, 787, MD-10/-11; all Airbus A300, A310, A319, A320, A330, A340, A350 and A380 models; and some Embraer 170 and 190 regional jets.

“The FAA is working diligently to determine which altimeters are reliable and accurate where 5G is deployed in the United States. We anticipate some altimeters will be too susceptible to 5G interference. To preserve safety, aircraft with those altimeters will be prohibited from performing low-visibility landings where 5G is deployed because the altimeter could provide inaccurate information.”

The FAA says altimeters that are not deemed safe will need to be retrofitted or replaced.

Twitter has brought its Communities to Android, after first rolling out the feature to iOS in September 2021.

When Twitter introduced Communities, it billed it as a way to for like-minded people to engage in more intimate conversations.

Some conversations aren’t for everyone, just the people who want to talk about the thing you want to talk about. When you join a Community, you can Tweet directly to that group instead of to all your followers. Only members in the same Community are able to reply and join the conversation so it stays intimate and relevant. 

Now the feature has made its way to Android, significantly expanding the room for engagement.

Just days after a hack that impacted user accounts, Crypto.com is revealing more details on the extent of the attack.

Crypto.com announced on Monday, January 17, that “a small number of users experienced unauthorized activity in their accounts.” The company reassured users their funds were safe, but users were quick to dispute that claim, pointing to unauthorized withdrawals from their accounts..

The company is now revealing a total of 483 accounts were hacked, and the equivalent of roughly $35 million was withdrawn. Fortunately for users, the company has reimbursed everyone impacted.

On 17 January 2022, Crypto.com learned that a small number of users had unauthorized crypto withdrawals on their accounts. Crypto.com promptly suspended withdrawals for all tokens to initiate an investigation and worked around the clock to address the issue. No customers experienced a loss of funds. In the majority of cases we prevented the unauthorized withdrawal, and in all other cases customers were fully reimbursed.

The incident affected 483 Crypto.com users.

Unauthorised withdrawals totalled 4,836.26 ETH, 443.93 BTC and approximately US$66,200 in other currencies.

Crypto.com first noticed the issue when some accounts were accessed without the corresponding 2FA input. The company halted all transactions, forced users to create new 2FA tokens, and migrated to a new 2FA architecture.

SAP will release its fourth-quarter results next week, but the company has already revealed its Q4 cloud revenue grew a whopping 28%.

SAP is one of the leading ERP companies in the world and, like others, has been focusing its efforts on the cloud. Those efforts are paying off, with a 28% increase in its cloud revenue.

The company is also reporting an increase in its cloud backlog to €9.45 billion, an increase of 32%.

“I am proud that our team has delivered an exceptional year with strong results, far exceeding our expectations,” said Luka Mucic, CFO. “After three quarters of home runs with our cloud momentum, we hit it out of the park this quarter. We are confident that we will continue our Q4 current cloud backlog growth in 2022. This is reflected in our accelerated cloud guidance for 2022 as we make great progress towards our mid-term ambition.”

The company is scheduled to report its full earnings January 27.
